Injured Woman Files Lawsuit Against Tractor Supply

Published on May 6, 2015 at 2:23 pm in Personal Injury.

A woman who claims she was injured in a Tractor Supply store is currently suing the company for their part in the accident. The manager of the store where the incident occurred is also named as a defendant in the suit.

The woman was attempting to get a container of dog food from one of the store shelves when both of her feet became trapped in an empty pallet that was concealed under some cardboard. She fell over and severely injured her neck, back, knees, and feet as a result.

Duty to Exercise Reasonable Care

According to the woman, the defendants later admitted that the empty pallet should not have been there, nor should it have been concealed. Additionally, the defendant’s assistant manager also informed the woman that they had not yet got around to transferring the pallet elsewhere.

The lawsuit claims that the defendants had a duty to keep the premises reasonably safe for all occupants. They also had a duty to watch out for conditions that may be unsafe. The woman believes that her injuries were caused by the defendants’ negligence to perform its duties.

In the lawsuit, the woman alleges that negligence on behalf of the defendants caused her to experience pain and suffering, lost earning capacity, loss of enjoyment of life, and medical expenses. She is being represented by attorneys from our firm, including Rudolph L. DiTrapano, J. Timothy DiPiero, and Robert M. Bastress III.
